1. Definitions
- "fahnipiles" / "we" / "us" — the retirement boarding house operating at 91/3 Thepkasattri Road, Thalang, Phuket 83110, Thailand.
- "Resident" — any individual occupying a room at fahnipiles under an agreed residency arrangement.
- "Family Member" / "Representative" — a person acting on behalf of a resident with their consent or by legal authority.
- "Agreement" — the residency arrangement agreed between fahnipiles and the resident or their representative, incorporating these terms.
- "Website" — the website accessible at https://fahnipiles.pro
2. Acceptance of Terms
By submitting an enquiry via this website, arranging a visit, or entering into a residency arrangement with fahnipiles, you acknowledge that you have read and agree to these Terms & Conditions. All residents must be 18 years of age or older. Residency arrangements may be entered into by a family representative acting with appropriate authority on behalf of an adult resident.
3. Nature of Services
fahnipiles is a non-medical retirement boarding house. Services provided include accommodation, prepared meals, housekeeping, laundry, and — at selected accommodation tiers — personal daily non-medical assistance and access to an activities programme. fahnipiles does not provide nursing care, clinical treatment, or any service that constitutes medical practice under Thai law. Residents with healthcare needs continue to access medical services independently or with staff coordination assistance.
Services are provided at the property in Thalang, Phuket, Thailand. The operation is conducted within Thai legal and regulatory frameworks applicable to private residential accommodation.
4. Residency Arrangement
4.1 Commencement
A residency begins when a written agreement is signed by both parties and an agreed deposit or first month's fee is received. Trial stays may be arranged under separate short-term terms discussed and agreed at the time of booking.
4.2 Room allocation
Rooms are allocated based on availability and the resident's expressed preference. fahnipiles reserves the right to offer an equivalent alternative if the specific room requested is no longer available at the time of commencement.
4.3 Personal property
Residents may bring personal items appropriate to the space available in their room. fahnipiles takes reasonable care of the property environment but is not liable for the loss or damage of personal belongings unless such loss or damage results directly from staff negligence.
5. Resident Responsibilities
Residents agree to:
- Treat other residents, staff, and visitors with courtesy and respect
- Observe reasonable house routines — including meal times and quiet hours — that allow the household to function comfortably for everyone
- Inform the house director of any significant change in health or personal circumstances that may affect their care needs or the care of other residents
- Not conduct activities within the property that are unlawful under Thai law
- Comply with reasonable requests from the house director relating to the safety or wellbeing of other residents and staff
6. Payment Terms
Monthly fees are payable in advance by the first day of each calendar month. All fees are quoted in Thai Baht (฿). Accepted payment methods will be confirmed at the time the agreement is concluded.
Current monthly rates are: Shared Garden Terrace Room ฿14,500; Private Sky View Suite ฿32,000; Premium Phuket Residence Package ฿52,000. Fees may be reviewed annually; a minimum of 60 days' written notice will be given before any increase takes effect.
A deposit equivalent to one month's fee is required at the commencement of residency. This deposit is returned within 30 days of departure, less any amounts properly outstanding to fahnipiles. Refund terms for trial stays are communicated separately at the time the trial is arranged.
7. Intellectual Property
All content on the fahnipiles website — including text, layout, imagery, and design — belongs to fahnipiles and may not be reproduced, distributed, or adapted without prior written permission. You are granted a limited, non-exclusive, non-transferable licence to access and view website content for personal enquiry purposes only.
8. Disclaimers
fahnipiles provides accommodation and support services with genuine care and professional standards. However, the website is provided on an "as available" basis and we make no warranty that it will be uninterrupted or free of technical errors. We are not responsible for the content or practices of any external websites to which our site may link.
As a non-medical facility, fahnipiles does not represent that any particular health outcome will follow from residency. Personal daily assistance is supportive in nature and does not constitute clinical or nursing care.
9. Limitation of Liability
To the fullest extent permitted under applicable Thai law, fahnipiles's liability arising from the residency arrangement or use of this website is limited to the total amount paid to fahnipiles in the three calendar months preceding the event giving rise to a claim. We are not liable for indirect, consequential, or economic losses, except where such limitation is not permitted by law.
10. Indemnification
Residents and family representatives agree to indemnify fahnipiles against any claims, costs, or liabilities arising from a material breach of these terms, including from conduct that causes harm to staff, other residents, or the physical property.
11. Termination of Residency
Either party may end the residency by providing 30 days' written notice to the other. fahnipiles may end the residency arrangement with immediate effect in circumstances where a resident's conduct presents a material risk to the safety, wellbeing, or dignity of other residents or staff. In such cases, the deposit will be returned less any amounts properly due.
Upon termination, any personal property remaining after 14 days will be stored for a further 30 days and thereafter handled in accordance with Thai law.
12. Dispute Resolution
Any dispute or concern arising from these terms or from the residency arrangement should first be raised with the house director in writing. We will endeavour to resolve matters informally within 14 days of receiving written notice. If informal resolution is not achieved, disputes will be subject to the jurisdiction of the courts of Phuket Province, Thailand, and governed by Thai law. This does not affect any statutory rights available to residents under applicable consumer protection legislation.
13. General Provisions
- Entire agreement: These terms, together with the residency agreement signed at commencement, constitute the full agreement between the parties and supersede prior representations.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any provision at any time does not constitute a waiver of future enforcement rights.
- Assignment: fahnipiles may assign its obligations to a successor operator with 60 days' notice to residents. Residents may not assign their residency to another party.
- Notices: Written notices should be sent by email to [email protected] or by post to the property address.
14. Changes to These Terms
We may revise these terms periodically. Current residents will be given at least 30 days' notice of material changes. The "Last Updated" date at the top of this page reflects the most recent revision. Continued residency following notification of revised terms constitutes acceptance of those terms.
